RIAA Threatens to Sue Hundreds for Illegal File-Sharing

WASHINGTON — The embattled music industry disclosed plans Wednesday for an unprecedented escalation in its fight against Internet piracy, threatening to sue hundreds of individual computer users who illegally share music files online.

The Recording Industry Association of America, citing significant sales declines, said it will begin Thursday to search Internet file-sharing networks to identify music fans who offer "substantial" collections of MP3 song files for downloading.

It expects to file at least several hundred lawsuits seeking financial damages within eight to 10 weeks.

Executives for the RIAA, the Washington-based lobbying group that represents major labels, would not say how many songs on a user's computer might qualify for a lawsuit. The new campaign comes just weeks after U.S. appeals court rulings requiring Internet providers to identify subscribers suspected of illegally sharing music and movie files.

The RIAA's president, Cary Sherman, said tens of millions of Internet users of popular file-sharing software after Thursday will expose themselves to "the real risk of having to face the music." He said the RIAA plans only to file lawsuits against Internet users in the United States.

"It's stealing. It's both wrong and illegal," Sherman said. Alluding to the court decisions, Sherman said Internet users who believe they can hide behind an alias online are mistaken. "You are not anonymous," Sherman said. "We're going to begin taking names."

Shopping at a Virgin Megastore in San Francisco, Jason Yoder was planning to delete file-sharing software he uses from his home computer because of the new lawsuit threat. He acknowledged using the Internet recently to find a copy of a rare 1970s soul recording, but he agreed that illegal downloads should be curtailed.

"It's sort of like a serial drunk driver has to have their license taken away at some point," said Yoder, 30.

Well, I guess I better draft a new letter to reply to them at the office. At work we get about 3 a month from RIAA about our customers. The boss and I concluded that for us to give RIAA details of our clients, they will need to obtain a court order first.

Okay, now let's just see how this really works. The RIAA shows up with (oh hell who knows...) 6 dozen lawyers to crucify my ass, and I show up by my self (maybe get a PD 4 kicks), I loose (well no shit, it aint gona be winnable), so what???

You see if you don't settle and they do take you to court, and get judgement, they can make YOU pay ALL court/lawyer fees. Check your state laws, this is how it works for CA and alot of states.

True, but we're in the older gen, and dont have to worry all to much about our credit anymore. These kids that RIAA is forcing to pay are young, in college or will soon be there. At that age they need credit to pay for their education.

That's what I see in RIAA, blood thirsty little bastard that don't give a shit about anything. And that's to say the very very least.

Heres what I have to say to the RIAA: If ya want me to buy the cd, then 1) Lower prices. Piracy does not effect your damn money *that* much. 2) Quit being greedy SOB's! 3) Endorse talented artists, not people that you can dress up, teach to lip sing, and then teach to dance. I don't care if they can do a pluto walk -- they still suck. 4) Don't be greedy! 5) Learn the rules of the game. Bullying just pisses people off. If you keep bullying people, someone WILL step up and take you down. 6) Change old laws instead of bringing in new ones that are vague. 7) Send out cease and desist letters like you LEGALLY have to. 8) Quit caring about the money; money isn't everything.

Theres a few more things but I forgot it. I'll remember right after I go to sleep though.

Yes, they can. And their parents will be forced to settle or go to court and pay all fees and judgment.

When I was 16 after I got my first Credit Card, sent to me by Shell I think it was. Pre-aproved and active, all I had to do was call an automated number and I was able to use it, with a $1,000 limit. Being 16, first car, and the out all night party type, I maxed that fucker out on gas, snacks and smokes. Never paid the bill, then BAM!!! I was in a world of legal and credit problems.

and i would draft a letter baced on the letter of the law about fair trials

@Taz: I didn't think it was legal for a minor under 18 to be given a credi card unless it was cosigned by the parents. Explanation?

Guess they need an Court order to get your name, the cops can do that, they don't, i think it is illegal in the U.S.A to do that, and what will they do when someone aimes out there search ips and cruses them whit some nasty ways, also i whant to point out by doing this, there homepage will never go online agen, that is an fact that we all know, for those idots out there, i don't know how to crack servers and i don't care for it anyway. As for the P2P network, i guess that we will see new Breed of them soon, that sends the data over the internet encrypted, in 56-128bits, then RIAA is fucked, that i know, also they are just rasing the price on cd's to get more money, and making the artist getting some small pennys...but most and manly they are all f*king IDOTS!!! (the sue the world, by campChaos.com is so true this days)

The FBI has been involved for a long time. They don't take any action, because it's not a high prority to bust people sharing songs. They're the ones that give RIAA and the MPAA access to the sharing networks. How do you think they have been able to gather IPs, and our names for those that they have already sued. The main FBI office that does most of the gathering is located in San Jose down the highway from me.

Having parental consent is a rather new law for minors entering into credit contracts. Back in 1991, there was little on this because it hadn't happened to often. But now days, credit card companies just send out the card to kids just starting to drive, or just turning 18. But even today, if a minor were to get a credit card/gas card, the parent would be the one held resposable for all charges.

Well, everyone should go to http://www.eff.org and join. I have been a member with them since 1992. More to the point on RIAA: http://www.eff.org/share/

Due to this crap, I am no longer buying any CDs by labels that are part of RIAA. It's a shame too, 80% of the songs I have in mp3 format I own. I download songs, and if I like the CD I go buy it. For now on, only private label artists will get my money. I'll no longer be buying CDs untill RIAA is gone.

Normally, I would feel guilty about illegally obtaining media such as software, especially smaller companies, but not so with music. My logic is as follows: I don't honestly care if the people whose music I download get any more money, as they are mostly extremely rich, or dead. If I traffic a Doors song, who is really getting my money. Morrison has been dead since 1971, and its sure as hell not going to charity. And If thats not enough, CDs are extremely expensive. Look at Dark Side of the Moon. This thing has been out since the early seventies, and its still as expensive as the day it came out (with consideration to inflation). Frankly, I feel that the whole MP3 trafficking movement has forced the RIAA to reconsider its policies and will eventually force them to drastically lower prices. For now, I shall continue to download.

I use Kazaa once in a while, but the majority of MP3's come from private ftp sites.

i found kazaa to be a great source for MP3's. since its much easier to search. but everythign else doesnt come from their.
